locking Spam – Are You An Accidental Spammer? Did you know there is a law against spam? In 2003 the FTC enforced the CAN-SPAM act. This law puts firm rules on how a business sends email. Penalties range up to $16,000 so being educated can save big. If you do email marketing, or send out promotions, you might be spamming and don’t know it. The following 7 rules will fill you in on how to stay legal and help fight spammers.
1. Don’t use any misleading information in the header of an email. In the “From”, “To”, and “Reply To” need to be an accurate representation of the actual person sending, receiving, and replying to an email.
2. Don’t use deceptive subject lines. The subject line must directly pertain to the subject; no bait and switch.
3. Identify the email as an ad if it is one. If you are advertising you absolutely need to directly say so.
4. Inform the receiving end of your location. You are required to post a physical address. This could be your local business address or a P.O. box.
5. Give an option to opt out. If you have clients on a recurring list, they must have a way to opt out if they desire. The only information you are allowed to require is their email address. Federal law prohibits charging a fee to opt out.
6. Honor opt out requests in a reasonable time frame. Businesses have 10 business days to honor and fulfill an opt out request.
7. Monitor others working on your behalf. If you hire another company to handle your email marketing, you can be held liable if they do not comply with the law.
