The courts in Florida are handling or trying to handle double the number of foreclosure cases they are scheduled to generally deal with. They do not have the wherewithal to manage this flood. This is leading to delays but that has not slowed down the number of new foreclosure filings. In the morning trucks piled with work relating to new foreclosures arrive at the court house to be filed. These are bulk transferred to hand trucks. Mazzeo said giving a vivid description, “Sometimes they sit there all day and we just file case after case after case. We do it as fast as we can. But there’s always more.”
The problem persists but solutions are elusive. Many proposals are coming through. One of them is mandatory negotiation but this will take time. Among immediate solutions are quick collections of special groups to clear the backlog in the local courts. The aim is to streamline the process and to see that the cases move in a timely manner.Judge Jennifer D. Bailey was the chairperson of Florida Supreme Court Task Force on Residential Mortgage Foreclosure Cases that was formed to finding a solution to this mess. She complained that the whole thing was “a lot of chaos.” Delivering its observations in August it recommended compulsory mediation for cases dealing with primary residences.
Bailey noted that there were innumerable lenders foreclosing and at the same time proceeding with foreclosures. Settlements were being reached just when the case was about to close. The result was that the case was settled “but not until it’s consumed every bit of judicial resource necessary to push that case through the system.”The task force also recommended the standardization of scattered irrelevant rules that were being availed of by judges trying to grapple with increasing number of cases. It also proposed the setting up of a repository on a website listing in details all the documents necessary for a foreclosure procedure.The Supreme Court of Florida will programme public hearings on the report of the task force and will then decide what to implement, refuse or modify.
